General Rental Conditions

General Terms and Conditions (GTC) of Noahkis Apartments GbR Mittelstraße 24, 56133 Fachbach represented by the managing directors Lena and Nabil Faddoul 1.

Scope of Application These General Terms and Conditions apply to all contracts regarding the temporary transfer of the holiday apartment by Noahkis Apartments GbR (hereinafter "Landlord") to guests (hereinafter "Tenant") as well as all related additional services and deliveries. Deviating conditions of the Tenant will not be recognized unless the Landlord expressly agrees to their validity in writing.

Conclusion of Contract A rental agreement is concluded when the Landlord confirms the Tenant's booking in writing, electronically, or by phone. The booking is binding as soon as the booking confirmation has been transmitted by the Landlord.

Payment The total amount for the rent is to be paid, unless otherwise agreed, no later than 7 days before arrival. For short-notice bookings (less than 7 days before arrival), the total amount is due immediately.

Prices The prices stated in the contract are understood as final prices and include the statutory value-added tax. Additional costs (e.g., for final cleaning or pets) will be clearly indicated in the booking process.

Check-in and Check-out The holiday apartment is available on the day of arrival from 3:00 PM. On the day of departure, the holiday apartment must be vacated by no later than 11:00 AM. A later departure requires the express consent of the Landlord and may incur additional costs.

Withdrawal and Cancellation The Tenant can withdraw from the contract before the start of the rental period. The cancellation must be made in writing or by email. In the event of a cancellation, the following conditions apply: Up to 30 days before arrival: free cancellation Up to 14 days before arrival: 50% of the total amount Less than 14 days before arrival or in case of no-show: 100% of the total amount. If the Landlord manages to rent the holiday apartment for the canceled period, the revenue minus a processing fee of €50 will be refunded.

Use of the Holiday Apartment The holiday apartment may only be used by the number of persons specified in the booking. Use for other purposes (e.g., commercial use, events) is prohibited unless there is explicit written permission from the Landlord. The Tenant agrees to treat the holiday apartment with care and to report any damages caused by him or his companions to the Landlord immediately.

Pets may only be brought along after prior written consent from the Landlord. An additional charge may be incurred for this, which will be indicated in the booking process.

Liability The Landlord is not liable for loss or damage to items brought in by the Tenant, unless the damage was caused by gross negligence or intention of the Landlord. The Landlord is only liable for damages arising from the use of the holiday apartment if these are due to intention or gross negligence.

Data Protection The personal data of the Tenant will be used solely for the processing of the contractual relationship and will not be disclosed to third parties unless this is necessary for the fulfillment of the contract or required by law.

Final Provisions German law applies. The place of jurisdiction, as far as legally permissible, is the registered office of Noahkis Apartments GbR. Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. In such a case, a legally permissible provision shall take the place of the invalid regulation, which comes closest to the economic purpose of the invalid provision.

The Bad Ems train station is within walking distance of the holiday apartment and offers connections to Koblenz, Wiesbaden, and other cities. From the station, you can comfortably reach the holiday apartment on foot in about 20 minutes or by taxi in a few minutes. Arrival by bus Bad Ems has a well-developed bus network. The nearest bus stop, "Bahnhofstraße", is just a few minutes' walk from the holiday apartment. From there, you have connections to regional bus lines.
